WebinarJam GDPR Compliance

GDPR stands for General Data Protection Regulation and its purpose is to prevent or stop businesses from abusing the data they gather from their customers and prospects.  

What is GDPR?

There are a million articles on the internet about the GDPR, but the only one that really matters is the 88-page REGULATION (EU) 2016/679.

The basic concept is customer protection. Even if you're not in Europe, the law affects almost every business and consumer on the planet, because as we've become a global economy, chances are someone from Europe will interact with your business. This could mean your business gets reported for infringement and you could incur a fine for non-compliance. However, regardless of your country of residence, adding GDPR will help you stay in compliance with the latest laws and regulations.

Here is the good news. 

Like many business owners, you most likely have been following the various policies set forth via CAN-SPAM that protect the consumer. Because of this, chances are you're already generally covered. The rules are about making certain businesses are educated about the rights and privacy concerns of their customers.

Now that we've covered the basics, what does that mean for your WebinarJam and EverWebinar accounts?

Your Role in GDPR

GDPR involves two different roles; controller and processor.

  • WebinarJam and EverWebinar are the Processors (meaning the platform, the tool).
  • You (the customer) are the controller (the owner of the data).

So what does that mean? Our job as the Processor is to provide you with the environment and protocols that allow you to display and collect your GDPR required information from your registrants within the 23 countries required.

Your job as the Controller is to implement and respect the GDPR practices. This means activating the GDPR within your account and providing a privacy policy. While there is a very generic privacy policy within the program, we strongly urge all customers to customize it to their business model.

How Can I Customize My Privacy Policy?

We understand feeling uneasy about handling the increasing number of legal documents that are required for a website. Sadly, we're not lawyers, nor do we play ones on TV.

While we cannot offer you specific guidance about customization, we have researched several sites that provide templates to help you generate and customize your privacy policy.

Whatever template site you decide to use, ensure that the templates offer the ability to customize.  Because every business and website is unique, customization is a MUST.

How Do I Add GDPR to My Webinars?

GDPR has been activated for all customers; however, only visitors from European countries who have accepted the GDPR will see the terms agreement checkboxes and the cookie acceptance banners.

To add the GDPR, please go to your profile (Marked #1 Below)

Click Settings (Marked #2 Below)

 

WebinarJam Account Settings

 

Be sure you are on GDPR (Marked #1 Below).

While the default setting is Activated for all customers, you can choose to Deactivate GDPR.

 

Activate GDPR

If you have selected "Activate GDPR", you have selected: "Yes, I want to be GDPR compliant. As a result, and only for visitors from certain European countries, a number of things will be displayed in my Forms and Pages: cookies acceptance banners, terms agreement checkboxes, etc."

GDPR Terms Agreement Label

If you have activated GDPR, you cannot toggle off "GDPR Terms Agreement Label" Force Mandatory (Marked #3 Below). You can edit "Yes, I agree to the GDPR terms and conditions."  To remove this option you will need to Deactivate.

Newsletter Agreement Label

You can Force Mandatory (Marked #4 Below) on the Newsletter Agreement Label. You can also edit, "Yes, I would like to receive future communications."

GDPR Terms Agreement Clauses

You may edit the Generic Privacy Policy as necessary (Marked #5 Below).

What Your Registrants Will See

Only registration page visitors from European countries that have accepted the GDPR will see the terms agreement checkboxes and the cookie acceptance banners.

They will see the following footer cookie acceptance banner as soon as they visit. It informs the vistors of the following:

We use cookies to ensure that we give you the best experience on our website. By remaining on this site, we will assume that you're OK with it.

WebinarJam Register Cookies

When your visitors click the "register button" the registration popup will appear.

Your European visitors will see GDPR checkboxes. This includes a checkbox for your GDPR Terms Agreement. By mousing over the GDPR Terms Agreement, they will see the privacy policy (Marked #1 Below). If it is long, they can scroll down to read the full text (Marked #2 Below).

The register button will not be clickable (Marked #3 Below) until the mandatory checkboxes are checked.

Mandatory Fields

Your GDPR Terms Agreement (Marked #1 Below) is mandatory if you have GDPR Activated. Your registrants will be required to check the box to register.

The "Newsletter Agreement" (Marked #2 Below) will display if you have GDPR Activated. If you have set it as mandatory your registrants will be required to check the box to register.

The "Register Now" button (Marked #3 Below) will not be clickable until all required fields and mandatory checkboxes are filled.

How to Translate Your GDPR

The GDPR checkboxes do not translate automatically. Please go to your Profile and Settings. 

Click the GDPR.

You can translate the Newsletter Agreement Label (Marked #1 Below), the GDPR Terms Agreement Clauses (Marked #2 Below), and the Privacy Policy (Marked #3 Below).
